Terms & Conditions

These Terms & Conditions ("Terms") apply to your access to and use of our website and online store (the "Site"), and to all purchases of products you make from us through the Site. In these Terms, "we", "our" and "us" refer to Beasley Pool Heating (ABN 15 007 730 403, and "you" and "your" refer to the person accessing the Site or placing an order.

Please read these Terms carefully. By accessing the Site or placing an order, you agree to be bound by these Terms. If you do not agree, you should not use the Site or place an order.

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) ("ACL") or any other law that cannot lawfully be excluded.


1. About these Terms

We may update these Terms from time to time by posting the updated version on the Site. The Terms that apply to your order are those in force at the time you place it. We recommend you save or print a copy of these Terms when you place an order.


2. Eligibility

To purchase from the Site, you must be at least 18 years old and able to enter into a legally binding contract. By placing an order, you confirm that you meet these requirements and that the information you provide is true, current and complete.


3. Products and availability

Our online store sells do-it-yourself (DIY) pool heating kits and related products for self-installation. We sell and deliver within Australia only.

We take care to describe and picture our products accurately, but:

  • Product images, colours and packaging are indicative only and may vary;

  • We may correct any error or inaccuracy, and change or update product information, at any time without notice; and

  • All products are subject to availability, and we may limit quantities or discontinue any product at any time.

DIY kits are intended for self-installation. It is your responsibility to confirm that a kit is suitable for your pool, roof and site before purchasing, and to install it in accordance with the manufacturer's instructions and all applicable laws, standards and regulations. If you are unsure which product is right for you, please contact us before ordering.


4. Pricing

All prices are in Australian dollars (AUD) and include GST unless otherwise stated. Delivery charges are additional and are shown at checkout before you complete your order.

We try to ensure all prices are correct, but errors may occur. If we discover an error in the price of a product you have ordered, we will contact you before dispatch and give you the option to confirm your order at the correct price or cancel it. If we cannot contact you, we may treat the order as cancelled and refund any amount you have paid.

Prices may change at any time, but changes will not affect orders we have already accepted.


5. Orders and acceptance

When you place an order, you make an offer to buy the product on these Terms. After you place an order, we will send you an order confirmation acknowledging that we have received it. This acknowledgement does not mean your order has been accepted.

A binding contract is formed only when we accept your order, which occurs when we dispatch the product to you (or notify you that it has been dispatched). We may, at our discretion, decline or cancel an order — for example, if the product is unavailable, if there was an error in pricing or description, if we are unable to authorise your payment, or if we suspect fraud or a breach of these Terms. If we cancel an order you have paid for, we will refund the amount paid in full.


6. Payment

You must pay for your order in full at the time you place it, using one of the payment methods offered at checkout. Payments are processed by our third-party payment providers. By providing payment details, you confirm that you are authorised to use the payment method and that the details are true and correct. We may use fraud-prevention checks before accepting an order.


7. Delivery

We deliver across Australia. Delivery costs and estimated timeframes are shown at checkout and depend on the product and your delivery address.

  • Delivery timeframes are estimates only and are not guaranteed. We are not liable for delays caused by our carriers or by events beyond our reasonable control.

  • You must provide a complete and accurate delivery address. We are not responsible for orders delayed, lost or returned because of an incorrect or incomplete address you provided.

  • Risk in the products passes to you on delivery to the address you provide (or to your nominated carrier or collection point). Title in the products passes to you once we have received payment in full.

  • If a product is returned to us as undeliverable, we will contact you. Additional delivery charges may apply to re-send it.


8. Consumer guarantees under the Australian Consumer Law

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and to compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

These guarantees apply in addition to, and are not limited by, these Terms, our Refund and Returns Policy, or any manufacturer's warranty.


9. Warranties

Many of our products come with a manufacturer's warranty (for example, Zane and Guardian product warranties). The terms, length and conditions of any manufacturer's warranty are set by the manufacturer and are provided with the product or on request.

Where a product you bought from us develops a fault, we will help you with your manufacturer's warranty claim and will honour your rights under the Australian Consumer Law. Please see our Refund and Returns Policy for how to make a claim. Note that a manufacturer's warranty may be affected if a product is not installed or used in accordance with the manufacturer's instructions.


10. Returns and refunds

Your rights to return products and obtain refunds, exchanges, repairs or replacements are set out in our Refund and Returns Policy, which forms part of these Terms. This includes our 30-day change-of-mind policy as well as your rights under the Australian Consumer Law.


11. Your account

If you create an account, you are responsible for keeping your login details secure and for all activity that occurs under your account. You must notify us promptly if you believe your account has been accessed without your authorisation. We may suspend or cancel your account if you breach these Terms.


12. Intellectual property

All content on the Site — including text, graphics, logos, images, product descriptions, and the design and layout of the Site — is owned by us or our licensors and is protected by intellectual property laws. You may use the Site for the purpose of browsing and purchasing products for your own personal use. You must not copy, reproduce, republish, distribute or commercially exploit any content from the Site without our prior written permission.


13. Acceptable use

You agree not to use the Site:

  • In any way that breaches any applicable law or regulation;

  • To transmit any harmful code, or to interfere with or disrupt the Site or its security;

  • To gain unauthorised access to any part of the Site or any connected system; or

  • To misrepresent your identity or provide false information.


14. Third-Party Links

The Site may contain links to third-party websites. We provide these links for convenience only and do not control or endorse those websites. We are not responsible for the content, products or practices of any third-party website, and you access them at your own risk.


15. Limitation Of Liability

Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy you have under the ACL or any other law that cannot lawfully be excluded.

Subject to the paragraph above:

  • To the extent permitted by law, our liability for a failure to comply with a consumer guarantee (other than a guarantee as to title, undisturbed possession or undisclosed securities) is limited, at our option, to replacing or repairing the goods, supplying equivalent goods, or paying the cost of doing so;

  • To the extent permitted by law, we are not liable for any indirect, special or consequential loss, or for any loss of profit, revenue, data or goodwill, arising out of or in connection with the Site, the products, or these Terms; and

  • To the extent permitted by law, our total liability to you for any claim arising out of or in connection with an order is limited to the amount you paid for the relevant product.

We are not liable for any loss or damage arising from your incorrect selection, installation or use of a product, except to the extent caused by us or required by law.


16. Events Beyond Our Control

We are not liable for any failure or delay in performing our obligations where that failure or delay is caused by events beyond our reasonable control, including natural disasters, extreme weather, fire, flood, pandemic, industrial action, failure of carriers or suppliers, or interruption of utilities or telecommunications.


17. Privacy

We handle your personal information in accordance with our Privacy Policy, which forms part of these Terms. Please read it to understand how we collect, use and disclose your information.


18. Termination

We may suspend or terminate your access to the Site at any time if you breach these Terms or if we reasonably consider it necessary to protect our business, our customers or others. Termination does not affect any rights or obligations that have already accrued.


19. Severability & Waiver

If any provision of these Terms is found to be invalid or unenforceable, that provision will be severed and the remaining provisions will continue in full force. Our failure to enforce any provision is not a waiver of our right to do so later.


20. Governing Law

These Terms are governed by the laws of South Australia and the Commonwealth of Australia. You and we submit to the non-exclusive jurisdiction of the courts of South Australia and the courts competent to hear appeals from them. This does not limit any rights you have to bring proceedings, or to rely on protections available to you, under the law of the Australian state or territory in which you live.
